Terms of Service

These Terms of Service ("Terms") are an agreement between you and Carlos Felipe Torres ("Storymoji", "we", "us" or "our") for your use of the Storymoji app and website (together, the "Service"). Please read them. By downloading or using the Service you agree to these Terms.

1. Who may use Storymoji

Storymoji is made for children to use together with a parent or guardian. If you are under the age of majority where you live, you may only use the Service with the involvement and consent of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use. By using the Service you confirm you are able to enter into this agreement, or that a parent or guardian has done so for you.

2. What Storymoji does

Storymoji lets a child build simple characters and, from a few choices, generates a short illustrated story that is read aloud. Stories, artwork, and narration are created automatically by software, including artificial-intelligence services. A family can optionally publish a story to get a link that others can open to read it.

3. No account, one device

The Service does not use accounts, names, or passwords. It identifies a device by an anonymous identifier so that free stories can be counted and a device's stories kept separate. You are responsible for the device you use the Service on.

4. Free use and subscriptions

Storymoji offers a free tier with a limited number of stories per month, and an optional paid subscription that unlocks additional features such as an enhanced narration voice. Subscriptions are sold as auto-renewing purchases through the Apple App Store or Google Play.

5. Automatically generated content

Stories, illustrations, and narration are produced automatically by software and AI services. We take real steps to keep content safe for children — content is checked before and after it is generated, image prompts are constrained, and the app falls back to a safe pre-written story if anything looks wrong. Even so, automatically generated content can occasionally be imperfect or unexpected, and it is provided on an "as is" basis. A grown-up should be involved, and if you ever see content that seems inappropriate, please stop and contact us so we can improve our safeguards.

The simple characters and story ideas you create are yours. By using the Service you give us permission to process them as needed to run the Service — to generate, store, display, narrate, and (if you choose to publish a story) make that story available at its share link. You are responsible for what you choose to type or publish. If you publish a story, anyone with the link can view it until it is unpublished.

8. Our content and rights

The Storymoji app, its name, logo, artwork, pre-written stories, and software are owned by us or our licensors and are protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. These Terms do not transfer any of our rights to you.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that generated content will always meet your expectations.

10. Limitation of liability

To the fullest extent permitted by law, Storymoji and its operator will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

11. Ending use

You may stop using the Service at any time by uninstalling the app. We may suspend or end the Service, or your access to it, if you breach these Terms or to protect the Service or its users.

12. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. If we make a material change to these Terms we will update the date above and, where the change is significant, make it noticeable. Continuing to use the Service after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Denmark, without regard to its conflict-of-laws rules, except where mandatory local consumer-protection laws apply to you.
